Website Terms of Service

This Site is operated by Fanfare Recruiting Services Ltd. This page states the Terms of Service (“Terms”) under which You may use this Site. Any person who wishes to use this Site must accept these Terms without change.

Fanfare reserves the right to revise these Terms any time and any revisions will be effective immediately upon posting to the Site. Please review these Terms periodically as Your continued use of the Site will indicate Your agreement with the revisions. These Terms do not alter or affect in any way the terms or conditions of any other agreement You may have with Fanfare or its affiliates for the provision of any goods, services or otherwise. If You do not accept these Terms as stated herein or any subsequent changes made by Fanfare, discontinue using this Site immediately.

“Fanfare” means Fanfare Recruiting Services Ltd.;

"Registered User" means a user who registers on the Website to open an account on the Registered User Site;

"You" and “Your” means either: (i) any user of the Site (whether or not a Registered User) not being a Minor; or (ii) a parent or guardian that has allowed a Minor to visit or use the Site.

"Minor" means any person who has not achieved the age of majority in the jurisdiction they live in (Minors must seek the consent of their parent or guardian to use the Site).

“Site” means collectively the Website and the Registered User Site.

"Website" means the Fanfare website, available at www.fanfarejobs.com;

“Marks“, ”Registered User Site“, “Terms”, ”Third-Party Sites”, “Website Content” have the meanings set out in these Terms.

General

Communications

When You visit the Site or send electronic mail to Fanfare, You are communicating with Fanfare electronically. You consent to receive communications from Fanfare electronically. Fanfare will communicate with You by e-mail or by posting notices or sending messages to You on the Site. You agree that all agreements, notices, disclosures, and other communications that Fanfare provide electronically satisfy any legal requirement that such communications be in writing.

Site in English

You agree that English will be the language of the Site and of all transactions occurring in connection with the Site, and You agree to waive any right to use and rely upon any other language or translations. You acknowledge that it is Your express wish that these Terms have been drawn up in English. Jurisdiction

These Terms and any action related thereto or related to the Site shall be governed, controlled, interpreted and defined by and under the laws of the Province of Ontario and the federal laws applicable therein without giving effect to any principles of conflicts of laws. You agree that any action at law or in equity arising out of or relating to these Terms or Your use of the Site will be filed only in a court located in Toronto, Ontario, Canada, and You hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts for the purpose of any such action. Your use of the Site is void where prohibited by laws in jurisdictions to which You are otherwise subject, and You agree not to visit or use the Site or the Website Content in any such circumstances.

Severability and Entire Agreement

If any provision, or any part thereof, of these Terms is held to be invalid, illegal or unenforceable, the validity, legality, or enforceability of the remaining provisions shall be in no way affected or impaired thereby and shall remain in full force and effect. Any failure of Fanfare to exercise any of the rights provided for herein shall not be deemed a waiver of any right hereunder. Except as provided for within these Terms, these Terms constitute the entire agreement between You and Fanfare with respect to Your use of Site.

Termination

Unless otherwise expressly stated herein to survive termination, You acknowledge and agree that these Terms shall remain in effect for so long as You use the Site. Fanfare has the right to edit or delete Your content and/or terminate these Terms and/or Your access to the Site, at any time, upon providing 2 days written notice to You, in our absolute discretion.

In addition, Fanfare has the right to immediately edit or delete Your account content on the Registered User Site and/or terminate these Terms, and/or Your access to the Site, at any time without notice in the event that:

A) You breach any term of these Terms;

B) Technical or any other issues (determined by Fanfare in its sole discretion) mean that it is no longer practicable for Fanfare to continue to operate the Site in whole or in part.

Your access to the Site shall automatically terminate in the event that You unsubscribe from the services Fanfare provides via the Site.

Acceptable Site Use

The Site may only be used for by Registered Users for lawful purposes. This Site is intended for use by the following types of registered users:

  • employers seeking employees;

  • post-secondary students and alumni seeking employment; and

  • Canadian accredited post-secondary schools, in order assist students and alumni seeking employment.

Subject to Your compliance with these Terms, Fanfare grants You non-exclusive, non-transferable, revocable permission to access and use the Site as a Registered User, provided that:

  • You are not a Minor, or if You are a Minor, You have obtained the consent of a parent, guardian or authorized educational supervisor. Any such parent, guardian or educational supervisor shall be held legally responsible for any such Minor’s use of the Site. Use of any part of the Site by a Minor is confirmation that the person is not a Minor or is a Minor who has received permission from a parent, guardian, or authorized educational supervisor to use the Site;

  • You agree to provide Fanfare with accurate and complete information when creating an account to access the Registered User Site;

  • You agree to accept responsibility for maintaining current and accurate account information;

  • You agree to accept responsibility for diligently maintaining the confidentiality of the password associated with Your account on the Registered User Site;

  • You acknowledge You are solely responsible for all activity that occurs under Your account on the Registered User Site;

  • You acknowledge You are solely responsible for all content submitted via Your account on the Registered User Site, including, but not limited to: communications of any kind, profile information, pictures, links (third party or otherwise), software, and any other content;

  • You warrant that You own all material that You post to the Registered User Site, or elsewhere on the Site, or have the right to collect, use, disclose and post such material.

Prohibited Site Use

In connection with Your use of the Site, You agree not to:

  • Conduct or promote any activities that are illegal, harmful or potentially harmful to any other person in any way, or are otherwise inappropriate (as determined in its sole discretion);

  • Submit any incomplete, false, or inaccurate information to the Site;

  • Alter, modify, or attempt to alter or modify, any part of the Site other than by submitting Your own user generated content to Your account on the Registered User Site;

  • Copy, aggregate or distribute, in any manner, any part of the Site including any of its content without Fanfare’s prior express permission to You for You to do so;

  • Access or attempt to gain access to portions of the Site for which You are not authorized to access;

  • Reverse engineer or attempt to reverse engineer or otherwise derive the source code of software comprising the Site;

  • Transmit or attempt to transmit or upload any viruses, worms, or any other harmful or potentially harmful software code;

  • Use the Site to post, e-mail or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;

  • Collect any personally identifiable information, including account names, email addresses, or other such information, for commercial purposes or purposes which violate privacy laws in Your jurisdiction and without Fanfare’s express permission to You for You to do so.

Site Content

All intellectual property rights in and relating to the Site and the content displayed on the Site and any other websites owned, operated or licensed by Fanfare, accessible from this Site, contain text, graphics, photos, software, logos, icons and other materials (“Website Content”) furnished by Fanfare. The Website Content is protected under Canadian copyright, patent and trade-mark laws and other laws of Canada and other nations. All Website Content, including the collection, arrangement, and assembly of such content, is the exclusive property of Fanfare. You may not copy, sell, license, transfer, publish, reproduce, modify, display, reverse engineer, decompile, disassemble, adapt, translate, transmit, arrange, bundle, sublicense, export, merge, loan, rent, lease, assign, outsource, host, distribute in anyway, prepare derivative works based on, re-post, make available to any person or otherwise use, either directly or indirectly, any of the Website Content, in whole or in part, in an form or by any means whatsoever, be they physical, electronic or otherwise, for any public or commercial purpose, without Fanfare’s prior written consent. You shall not permit, allow or do anything that would infringe or otherwise prejudice Fanfare’s proprietary rights or allow any third party to access the Website Content. The restrictions set out herein shall survive termination of these Terms and will not apply to the limited extent the restrictions are prohibited by applicable law.

Trade-marks, service marks, and logos appearing in this Site (the “Marks”) are Fanfare’s property or are the property of the party that licenses the use of the Marks to Fanfare. All intellectual property rights to the Marks are retained by their respective owners and nothing contained in these Terms or on the Site operates to assign or grant, explicitly, implication, by estoppel, or otherwise, any license or right to use any or all of the Marks displayed on this Site.

To adequately use the Site, You and other users of the Site may be required to upload content to it. Fanfare does not verify, endorse or accept responsibility for any such user submitted content. As such, Fanfare does not represent or guarantee the truthfulness, accuracy or reliability of the content submitted by users of the Site. Should You choose to access any content submitted by other Users, You accept that Your reliance on any such content will be at Your own risk.

For greater certainty, Fanfare has no responsibility or obligation to pre-screen, monitor or remove content submitted by users. Fanfare reserves the right to determine, at its sole discretion, whether any content You submit complies with these Terms. Fanfare also reserves the right to remove all or any part of the content You submit found to not satisfy these Terms, without prior notice to You.

By submitting content to any area of the Site, You grant Fanfare and its affiliates a royalty-free, worldwide, perpetual, irrevocable, sub-licenseable, non-exclusive license (under any and all applicable law governing intellectual property to use, copy, store, reformat, publish, translate, distribute, communicate to the public and display all or any part of the content. You also permit any User to use, copy, store, reformat and display such content for personal use. You warrant that You are the owner, licensor, or authorized user of all content You submit and have the required authority to grant the license described above.

Registration and Passwords

As part of the registration process, You will select an account name and password and submit certain other required information to Fanfare. You will then have the ability to access a restricted area of the Site which is separate from the Website (the “Registered User Site”) to post information to and customize Your account, view the information of other Registered Users of the Site and communicate with them.

You accept responsibility for maintaining the security of the account name and password You use to access the Registered User Site. If the security of Your password has been breached or You suspect Your password may have been comprised, You must notify Fanfare immediately. This is important because You are responsible for any and all activity occurring under Your account and accept all risks associated with any unauthorized activity.

Links

The Site may contain links to third-party web sites (“Third-Party Sites”). Such links are provided solely as a convenience to You. Fanfare does not endorse the contents of Third-Party Sites and does not accept responsibility for the appropriateness, operation, accuracy or legality of Third-Party Sites. By accessing Third-Party Sites, You do so at Your own risk.

You are granted a limited, non-exclusive, non-assignable, revocable permission to create a text link directly to the Home Page of the Site for non-commercial purposes. Any such links shall not put frames around the Site nor claim to represent Fanfare. You agree that the linking site will not contain any material that is illegal, distasteful or inappropriate for the Users of this Site.

No warranty; Liability and Indemnity

The Site and all content in the Site is provided "AS IS" and “AS AVAILABLE” and without any representation. warranty, guarantee, condition of any kind or nature whatsoever either express or implied, nor (without prejudice to the comprehensive nature of the foregoing) does Fanfare make any representations concerning the merchantability, fitness for a particular purpose, title, non-infringement, suitability, reliability, or accuracy for any purpose of the Site or the contents of the Site.

For greater clarity, Fanfare does not represent or warrant that (i) the functions or content contained in this Site will be uninterrupted, reliable, accurate, complete, suitable, valid, truthful, error-free or will meet Your requirements in any way; (ii) that defects will be corrected, or that this Site or the server that makes it available are free of viruses or other harmful components; (iii) the use of the content and the Site will be timely, secure, or error-free; or (v) the quality of any content obtained by You through Your use of the Site will meet Your expectations. The content may include technical inaccuracies or typographical errors, and Fanfare may make changes or improvements to the Site at any time.

Fanfare and its subsidiaries, agents, suppliers, officers, directors and shareholders, shall not be liable to You or to any other person in contract, tort (including negligence), or otherwise, for consequential, indirect, or punitive loss or damages, loss of business or business information, business interruption, loss of profits or anticipated savings, loss of contracts or loss of or damage to data, or for pure economic loss arising from, Your use of or Your inability to use the Site, any claim that Your use of the Site violates any intellectual property rights or privacy rights of any person and any failure in performance of the Site, regardless of whether any such loss or damage would arise in the ordinary course of events or otherwise or is reasonably foreseeable or is otherwise in the contemplation of the parties. In addition, Fanfare cannot be held liable for any content that is posted by users or Registered Users to the Site. You acknowledge and agree that it is not possible for all such content to be perfectly screened, and You agree to take the risk that content may be posted which violates Your rights or contains errors or inaccuracies, without any recourse against Us.

You will indemnify, defend and save harmless Fanfare and all of Fanfare’s subsidiaries, agents, suppliers, officers, directors and shareholders from and against any claims, losses, judgements, actions, proceedings, damages, costs and expenses (including without limitation, reasonable legal and other fees and disbursements), whether direct, indirect, or consequential, howsoever caused, incurred by any of the foregoing parties due to or resulting from Your use or misuse of the Site, the Site Content, from submissions that You collect, use, disclose, post, submit or transmit through the Site or from Your violation of these Terms.

Any material obtained through the use of the Site is obtained at Your own risk, and You are solely responsible for any damage to or the destruction of Your computer system or loss of data or any other damage whatsoever that results from the download of any such material in its original form or as a result of any virus, Trojan horse, time-bomb or malicious software code.

These Terms remain subject to all applicable law and in no way restricts your statutory rights.

In some jurisdictions, limitation or exclusion of liability is only permitted where such limitation is fair and reasonable.

This Site is only a venue for employers to post job opportunities and workshops, post-secondary students to submit applications and post-secondary schools to track student employment activities. Fanfare is not involved in any interactions between Users. As such, Fanfare is not involved in, or responsible for, any employment decisions made by any Users of the Site. Fanfare does not confirm that each User is who they claim to be, nor does Fanfare have any control over the quality, legality or accuracy of jobs opportunities or workshops posted, job applications submitted, an employer’s ability to offer job opportunities and workshops or a student’s ability to fill job and workshop openings. Having considered all matters, You agree that the limitations of liability set out in these Terms are fair and reasonable.

If, notwithstanding the foregoing, Fanfare should be found liable for any loss or damages which arise out of or is in any way connected with any of the above described functions or uses of this Site or its content, you acknowledge that Fanfare’s maximum liability will in no event exceed, in the aggregate, CDN$100.

Privacy Policy

When You register Your account with the Site, You will be asked to provide Fanfare with Your personal information. Fanfare’s privacy policy appears in a separate document and outlines how Fanfare will treat Your personal information and data, and the care You must exercise while using the Site. Please see the Fanfare’s Privacy Policy for further details regarding Your personal information.

Registered User Site Privacy

Your account on the Registered User Site will contain personal data about Your professional qualifications and interests and will be accessible to others who use the Site. By using the Site You agree that You understand that Fanfare use reasonable efforts to ensure user privacy, but cannot be held responsible or liable in any way, shape, or form for the disclosure, loss or deletion of any information or Site content resulting from, but not limited to, use of stolen or fraudulently obtained Registered User passwords, or otherwise. The terms of this paragraph shall survive termination of these Terms or Your use of the Site.
